Welcome to Craftphilia. These Terms of Service ("Terms") govern your access to and use of the website craftphilia.com (the "Site") and the purchase of products through the Site. The Site is operated by Craftphilia Limited ("Craftphilia," "we," "us," or "our"), a company registered in Hong Kong SAR.

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. Craftphilia machines contain moving mechanical parts; they must be operated in accordance with the user manual, and by minors only under adult supervision.

2. Products, Pricing & Availability

  • All prices are listed in U.S. dollars unless otherwise stated. Applicable taxes are calculated at checkout.
  • We make every effort to display our products and their specifications accurately. However, we do not guarantee that all descriptions, images, pricing, or availability information is error-free. We reserve the right to correct errors and to update product information at any time without prior notice.
  • In the event a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the affected order and issue a full refund.
  • We reserve the right to limit quantities, discontinue products, or refuse service to anyone at our reasonable discretion.

3. Orders & Payment

  • Your order constitutes an offer to purchase. An order is accepted when we send a shipping confirmation. We may cancel or refuse an order for reasons including suspected fraud, pricing errors, or stock unavailability; in such cases you will receive a full refund.
  • You agree to provide current, complete, and accurate purchase and account information, and to promptly update it as needed.
  • Payments are processed by third-party payment providers. We do not store your full payment card details.

4. Shipping, Returns & Warranty

Shipping, returns, refunds, and warranty service are governed by our Shipping Policy, Return & Refund Policy, and Warranty Policy, each of which is incorporated into these Terms by reference.

5. Software & Firmware

Craftphilia machines operate with companion software and firmware. Your use of such software may be subject to additional license terms presented at installation or activation. We may release updates that improve functionality, security, or safety; some features may require software updates to function as described.

6. Intellectual Property

All content on the Site — including text, graphics, logos, product designs, images, videos, and software — is the property of Craftphilia Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent. "Craftphilia" and the Craftphilia logo are trademarks of Craftphilia Limited.

7. User-Generated Content

The Site and our community channels may allow you to submit content, such as product reviews, photos, videos, comments, and design patterns ("User Content").

  • You retain ownership of your User Content.
  • By submitting User Content, you grant Craftphilia a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute that content in connection with the Site, our products, and our marketing, in any media.
  • You represent that you own or have the necessary rights to your User Content, and that it does not infringe the rights of any third party or violate any law.
  • You are solely responsible for designs you create, upload, or share, including ensuring they do not infringe third-party intellectual property rights.
  • We may remove or decline to display any User Content at our discretion.

8. Prohibited Uses

You agree not to use the Site or our products: (a) for any unlawful purpose; (b) to infringe intellectual property rights; (c) to upload malicious code or interfere with the Site's operation; (d) to scrape, harvest, or collect data without authorization; or (e) to submit false or misleading information.

9. Safety & Proper Use

Our products must be assembled, operated, and maintained in accordance with the official user manual and safety instructions. Craftphilia is not responsible for damage or injury resulting from misuse, unauthorized modification, or failure to follow the documentation.

10. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind not expressly stated in our Warranty Policy, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Craftphilia's total liability arising out of or relating to these Terms or any product purchased through the Site shall not exceed the amount you paid for the product giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including statutory consumer rights.

12. Indemnification

You agree to indemnify and hold harmless Craftphilia Limited and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your User Content, or your misuse of the Site or our products.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.

Informal resolution first: If you have a dispute, contact us at support@craftphilia.com — most concerns can be resolved quickly and amicably.

Arbitration: Any dispute that cannot be resolved informally shall be finally resolved by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under its rules in effect at the time, seated in Hong Kong and conducted in English. You and Craftphilia each waive the right to a trial by jury and to participate in a class action. You may instead bring an individual claim in your local small claims court if it qualifies.

14. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the latest revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
